Terms of Service

These terms apply when you use this website and when you buy from POUCHUP. Please read them before placing an order — by placing an order you agree to them. If you do not agree, please do not use the site.

1. Who we are

POUCHUP is a trading name of REDPXL TRADING LTD, a company registered in England and Wales (company number 16454649), registered office 7.16 77 Marsh Wall, Canary Wharf, London, England, E14 9SH. “We”, “us” and “POUCHUP” mean that company.

2. Eligibility — legal purchase age only

Our products contain nicotine and are strictly for adults of legal purchase age. We deliver to the United Kingdom only, where that age is 18 or over. If you are ordering from another country you must also be of legal purchase age where you live, which in the United States is 21 or over. By ordering you confirm that you are. Your age is confirmed at checkout, and ID may be requested on delivery. Full detail is in our Age Policy. We may cancel any order where we cannot be satisfied that the buyer is of legal purchase age.

3. Orders and order acceptance

When you place an order you make an offer to buy. Your order is accepted, and a contract is formed, only when we send you an email confirming dispatch — not when you receive an order acknowledgement. We may decline or cancel an order, for example if an item is out of stock, if we cannot verify your age, or if we suspect fraud. If we cancel an order you have paid for, we will refund it in full.

4. Price and payment

Every can is £4.99. Prices are shown on each product page and include VAT where applicable. Payment is taken at checkout through our payment provider, Viva.com; we do not store your full card details. All charges are made in pounds sterling (GBP). If you are browsing from the United States, prices may be shown in US dollars for convenience, but the charge itself is always in GBP. The exact GBP amount is shown at checkout before you pay, and your bank sets the final exchange rate. We try to keep prices accurate, but if we find a genuine pricing error before dispatch we will contact you before proceeding.

5. Delivery

We dispatch from a UK unit. Dispatch times, couriers, costs and delivery estimates are set out in our Shipping Policy. Risk in the goods passes to you on delivery.

6. Cancellation, returns and refunds

You may have the right to cancel under the Consumer Contracts Regulations, and unopened, sealed cans may be returned. Because these are consumable products, opened pouches cannot be returned for hygiene reasons. The full process, windows and exceptions are in our Return & Refund Policy.

7. Acceptable use

You agree not to misuse the site, to provide accurate information when ordering, and not to resell our products to anyone under 18. You may not use the site in any unlawful way or attempt to interfere with its security or operation.

8. Nicotine — important notice

Nicotine is an addictive chemical. Our products are intended for existing adult nicotine users. They are not a smoking-cessation aid and are not marketed to help you stop using nicotine. If you do not already use nicotine, the honest advice is not to start. Keep out of reach of children and pets.

9. Limitation of liability

Nothing in these terms limits our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud. Subject to that, we are not liable for losses that were not foreseeable, or that arise from your own misuse of the products. Nothing here affects your statutory rights as a consumer. 10. Governing law

These terms are governed by the law of England and Wales, and disputes are subject to the courts of England and Wales. This does not remove any consumer-protection rights available to you in your country of residence.

11. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the one published when you placed it. The “last updated” date above shows when they last changed.
